Terms of Service - Sostenutoo

1. Purpose

These Terms of Service (ToS) govern the use of the Sostenutoo platform, an orchestra management service that enables musicians and conductors to access musical programs, sheet music, and events.

By creating an account on Sostenutoo, you unconditionally accept these Terms of Service.

2. Definitions

Service: the Sostenutoo platform accessible at sostenutoo.com
User: any person creating an account (musician, conductor, or administrator)
Orchestra: a musical group managed through the platform
Content: programs, sheet music, events, and other shared data

3. Access to the Service

3.1 Account Creation

To use Sostenutoo, you must create an account by providing:

A valid email address
A secure password (or sign in via Google)
Your full name
Your role (musician or administrator)
Your instruments (if musician)

3.2 Account Responsibility

You are responsible for:

Keeping your login credentials confidential
All activities carried out through your account
The accuracy of the information you provide

4. Use of the Service

4.1 Permitted Use

You may use Sostenutoo to:

View and download your orchestra's programs and sheet music
Participate in events (rehearsals, concerts)
Communicate with members of your orchestra
Manage your musical profile

4.2 Prohibited Use

The following is strictly prohibited:

Using the Service for any unlawful purpose
Sharing your login credentials with third parties
Distributing inappropriate, offensive, or illegal content
Attempting to access other orchestras' data without authorization
Copying, modifying, or distributing platform content without authorization
Disrupting the operation of the Service

5. Intellectual Property

5.1 Platform Rights

Sostenutoo and all its elements (code, design, logo) are protected by copyright law. Any unauthorized reproduction is prohibited.

5.2 Sheet Music Rights

Sheet music shared on the platform remains the property of its respective authors and publishers. Its use is restricted to the context of your orchestra and may not be publicly distributed without authorization.

5.3 User Content

You retain all rights to the content you publish (messages, announcements). By using Sostenutoo, you grant us a license to host and display such content within the scope of the Service.

5.4 Chat and Announcement Usage Rules

When using the communication features (chat, announcements), you agree to:

Respect other members: no harassment, insults, discrimination, or offensive content
Refrain from spamming: avoid sending repetitive or irrelevant messages
Respect privacy: do not share other people's personal information without their consent
Use chat for musical purposes: messaging is intended for coordinating your orchestra activities

5.5 Rules Regarding Images Shared in Chat

If you choose to share images in conversations, you agree to:

Share only appropriate images: no violent, pornographic, harassing, discriminatory, or illegal content
Respect copyright: only share images for which you hold the rights or are authorized to distribute
Respect the right to one's image: obtain consent from photographed individuals before sharing their image
Observe size limits: images are automatically compressed (limit: 10 MB per image)
Use appropriately: images should serve musical coordination purposes (annotated sheet music, event photos, stage plans, etc.)

Liability: You are solely responsible for the content of images you share. Sostenutoo does not proactively moderate images but may intervene upon receiving a report.

Moderation: Your orchestra's administrators may delete any inappropriate message (text or image). In the event of serious or repeated abuse, Sostenutoo reserves the right to suspend your access to the chat or your account.

Deletion: When a message containing an image is deleted, the image is permanently removed from storage within 24 hours.

6. Personal Data

The processing of your personal data is governed by our Privacy Policy.

Your data is shared only within your orchestra and is never sold to third parties.

Shared images: Photos you share in the chat may contain personal data (faces, identifiable information). You acknowledge that these images will be visible to all members of your orchestra. Images are securely hosted in the European Union (Supabase EU – Paris).

7. Subscriptions and Payments

7.1 Freemium Model

Sostenutoo offers:

Free version: limited access to basic features
Premium version: advanced features via subscription

7.2 Pricing

Prices are displayed on the platform and may be changed with 30 days' prior notice.

7.3 Cancellation

You may cancel your subscription at any time from your account. No refund will be issued for the current billing period.

8. Service Availability

We strive to ensure maximum service availability but cannot guarantee:

Uninterrupted access (maintenance, technical outages)
A complete absence of bugs or errors

We disclaim all liability for any temporary interruption of the Service.

9. Account Termination

9.1 By the User

You may delete your account at any time from your settings. Your data will be erased within 30 days.

9.2 By Sostenutoo

We reserve the right to suspend or delete your account in the event of:

Violation of these Terms of Service
Fraudulent use of the Service
Harmful behavior toward other users

10. Limitation of Liability

Sostenutoo shall not be held liable for:

Direct or indirect damages arising from the use of the Service
Loss of data due to a technical issue
Disputes between users within the same orchestra
Content published by users

11. Amendments to the Terms of Service

We reserve the right to amend these Terms of Service at any time. Users will be notified by email or through the platform of any significant changes.

Continued use of the Service after any amendment constitutes acceptance of the updated Terms of Service.

12. Applicable Law

These Terms of Service are governed by French law. Any dispute shall be submitted to the competent French courts.
